Our Legal System

Our country was founded on the notion of equality under the law and the importance of individual rights and liberties. While our legal system has its flaws, it can be fair to those who use it right. Keep these thoughts in mind:

  • Our legal system is here to protect everyone. Our judicial system is designed to provide equal access to all parties appearing before it, whether company, corporation or individual. Justice is supposed to be "blind" because it does not see the wealth or color or sex of an individual - it views them all the same and is only interested in the truth. While it is not perfect, we believe in the system and its ability to fairly protect everyone.
  • Every individual has rights in the courts. Our laws were not written to help one class of people over another. Rather, the goal of our legal system is to help all persons. We have watched as a person with next to nothing has taken on and beaten the largest and most powerful corporations. Knowing how to operate in our courthouses increases the chance of having your problem resolved in the fairest way possible by a jury of your peers.
  • There are numerous courts to approach, know which one is right for your problem. There are municipal, justice, county, district, state and federal courts. We work with you to decide which court is the best option, and how to approach each case so that you have the best opportunity for a positive outcome.
  • There are alternatives to jury trials. Most disputes are resolved without formal legal proceedings. However, some matters require the filing of a lawsuit and determination by a jury. While the court system is an available option in most cases, we will first seek less expensive and time consuming means to resolve your problem if that will result in the best outcome for you. Our services start with trustworthy advice and counsel. Next, we examine whether there are any administrative agencies, state and/or federal, that can assist you to resolve your problem. Then we look at whether your case could be submitted to arbitration or a pre-suit mediation. Of course, each case if different and what works well for one client may not be the best solution for a different client. Whatever your case involves, we want you to know and understand your rights. Further, we prepare each case for trial, regardless of whether or not the case might settle, to ensure that we are doing the best for our clients.
  • It takes time to go to trial. Bexar County , as well as the surrounding counties, have busy dockets, which means that it can take anywhere from 8 months to over a year before a trial begins. During this time, we work on preparing your care. Sometimes, the amount of needed preparation and busy court schedule can cause a delay of two or more years to get to trial. This means that our clients have to devote time and energy to the continued preparation of their case, but the more prepared we are for trial the better the result. Again, our commitment is to always do what is best for our clients. Many factors that delay justice are beyond our control, but we take the proper actions to avoid adding to that delay so that your problem is resolved as soon as possible.
  • Your role and our role in the litigation and trial process. We work very closely with our clients to bring their problem to the best resolution possible. We do the talking, but we use your words and your experiences as the building blocks of our arguments. That means that before we talk, we're great listeners. We hear your needs and feel what you've gone through, which makes us much more successful representing your case. Your role is to be completely open and honest with us and to let us know every detail that we need without holding back.
  • Protection of the law without going to trial. Even if a trial is not necessary or even desired, we can and will use the law to protect you. Often, situations occur because someone else was not aware of the law. It is part of our job to educate them on what happened and to let them know that if it is not fixed, the law will protect our client. On the other side of the coin, sometimes our clients do not realize that they have done something that violates the law. Once again, part of our job is to educate you and bring about the best resolution possible.
